These PissedConsumer Merch online shop Terms of Use (the “Shop Terms”) govern use and operation of PissedConsumer.com’s (the “Site”, “We”, “Us”, “Our”) online merchandise shop (the “Shop”, the “PissedConsumer Merch”, “PissedConsumer Merch shop”, “PissedConsumer Merch online shop”). The Shop Terms constitute an integral part of Our Terms of Use Agreement (the “Agreement”) and incorporate all defined terms and conditions set forth in the Agreement. To reiterate specifically for the purposes of these Shop Terms, Our Privacy Policy (the “Policy”), which also constitutes an integral part of the Agreement, shall be fully applicable to these Shop Terms as well.

We, the Site, are an Online Review and Reputation Management Platform; for consumers who seek a place to share their purchase experiences, and for companies that need help to improve their reputation and customer service processes.

In the event the provisions of these Shop Terms conflict with any provision of the Agreement and/or the Policy, the provisions of the Agreement and/or the Policy shall prevail. No terms or conditions of the above-mentioned Agreement and/or Policy shall be negated or changed as a result of these here-stated Shop Terms.

You acknowledge that these Shop Terms govern customers’ (“Customer”, “You”, “Your”, “Buyer” separately; “Customers”, “You”, “Your”, “Buyers” collectively) use of the Shop and/or Our products and/or Our services, and form a binding legal agreement between You and Us.

By making a purchase from the Shop or using the Shop in any way, You agree to be bound by these Shop Terms. You must agree to all of the Shop Terms. If You do not agree to the Shop Terms, You are not permitted to use the Shop.

By accessing, browsing or using the Shop and/or Our products and/or Our services, You acknowledge that You have read and understood these Shop Terms, including and incorporated herein by reference the terms of the Shop Privacy Policy, and You agree to be bound by them and to comply with all applicable laws and regulations regarding Your use of the Shop and/or Our products and/or Our services.

We reserve the right, at Our sole discretion, to change, modify, add the Shop Terms or portions of the Shop Terms or remove portions of the Shop Terms, at any time. You are responsible for checking the Shop Terms for changes. Your continued use of the Shop and/or Our products and/or Our services shall mean that You accept and agree to the changes.

We reserve the right, at Our sole discretion, at any time and without any prior notice, to change, modify, add to the Shop and/or Our products and/or Our services including, but not limited to features, assortment available in or through the Shop. Unless expressly stated otherwise, any new features, new services, new products, enhancements or modifications to the Shop implemented after You first access the Shop are subject to the Shop Terms.

We reserve the right, at our sole discretion, and without any prior notice, to terminate Your access to the Shop, or exercise any other remedy available, if We believe that You violated any of the Shop Terms. In addition to other prohibitions as set forth in these Shop Terms, You are prohibited from using the Shop or its content: (a) for any unlawful purpose; (b) to solicit others to perform or participate in any unlawful acts; (c) to violate any international, federal, provincial or state regulations, rules, laws, or local ordinances; (d) to infringe upon or violate Our intellectual property rights or the intellectual property rights of others; (e) to harass, abuse, insult, harm, defame, slander, disparage, intimidate, or discriminate based on gender, sexual orientation, religion, ethnicity, race, age, national origin, or disability; (f) to submit false or misleading information; (g) to upload or transmit viruses or any other type of malicious code that will or may be used in any way that will affect the functionality or operation of the Shop or of any related website, other websites, or the Internet; (h) to collect or track the personal information of others; (i) to spam, phish, pharm, pretext, spider, crawl, or scrape; (j) for any obscene or immoral purpose; or (k) to interfere with or circumvent the security features of the Shop or any related website, other websites, or the Internet. We reserve the right to terminate Your use of the Shop or any related website for violating any of the prohibited uses.

At Our Shop We make every attempt to ensure that Our online assortment of products is as accurate and complete as possible. We use the Direct to Garment (DTG) printing method for some of Our products. Please note that color disparities can arise. As a result, the final appearance of Your prints may be influenced by a multitude of distinct factors such as different printers, color profiles, settings, and processes. We want to be transparent and ensure Your satisfaction, which is why We cannot promise absolute color precision of 100% for Our products.

The content of the pages of the Shop is for Your general information and use only. It is subject to change without notice. Neither We nor any third parties provide any warranty or guarantee as to the accuracy, timeliness, performance, completeness, or suitability of the information and materials found or offered in the Shop for any particular purpose. You acknowledge that such information and materials may contain inaccuracies or errors, and We expressly exclude liability for any such inaccuracies or errors to the fullest extent permitted by law. Your use of any information or materials in this Shop is entirely at Your own risk, for which We shall not be liable. It shall be Your own responsibility to ensure that any products, services or information available through the Shop meet your specific requirements. The Shop contains material which is owned by or licensed to Us. This material includes, but is not limited to, the design, layout, look, appearance and graphics. Our (i.e. PissedConsumer) trademarks, logos and any designs used or displayed are trademarks and/or service marks owned by, and licensed by Us from, Consumer Opinion LLC. Any use of Our (i.e. PissedConsumer) trademarks, service marks, product names and company names or logos, including the reproduction, modification, distribution or republication of same without the prior written permission of Consumer Opinion LLC, is strictly prohibited. Other trademarks, service marks, trade names and company logos are utilized in the Shop by Us in accordance with the provisions of the fair use doctrine and the U.S. trademark law.

You will defend, indemnify and hold Us and Our subsidiaries, affiliates, officers, agents, employees, partners and licensors harmless from any claims, demands, losses, costs, liabilities and expenses (including, but not limited to reasonable attorneys' fees) relating to or arising out of Your use of the Shop, including, but not limited to, any breach by You of the Shop Terms, Your violation of applicable laws, or Your violation of any rights of another person or entity. You agree to cooperate as fully as reasonably required in the defense of any such claim. We reserve the right to assume the exclusive defense and control of any matter otherwise subject to indemnification by You, provided that You shall remain liable for any such claim.
